Terms and Conditions

These Terms and Conditions ( “Terms” ) govern your access to and use of Juba Car , operated by [Juba Car] ( “Juba Car,” “we,” “us,” or “our” ), including the Juba Car mobile application, website, seller tools, dealer tools, messaging features, listing services, support channels, and related services (together, the “Service” ).
By creating an account, browsing listings, posting a vehicle, contacting a seller or buyer, purchasing any paid feature, submitting personal data, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
- About Juba Car
Juba Car is a vehicle marketplace and discovery platform. The Service may allow users to browse vehicles, create vehicle listings, contact sellers or buyers, manage dealer profiles, save vehicles, use search and map features, receive notifications, report content, purchase listing-related services, and access related vehicle services.
Unless we expressly state otherwise in writing, Juba Car is not the buyer, seller, dealer, owner, broker, importer, exporter, insurer, lender, escrow agent, transportation provider, inspection provider, or tax/registration adviser for any vehicle. Transactions, inspections, payments for physical vehicles, title transfers, registration, insurance, taxes, delivery, and after-sale issues are the responsibility of the users involved and any applicable third-party providers.
- Eligibility
– You must be at least 18 years old, or the age of legal majority required in your jurisdiction, to create an account, post a vehicle, contact sellers, purchase paid features, or transact through the Service.
– You may use the Service only if you can legally enter into a binding agreement and comply with applicable laws.
– If you use the Service for a business, dealership, employer, or other organization, you represent that you have authority to bind that organization to these Terms.
- Accounts and security
– You must provide accurate, current, and complete account information and keep it updated.
– You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
– You must promptly notify us at [info@jubacar.com] if you suspect unauthorized access or misuse of your account.
– We may require verification, phone/email confirmation, identity checks, dealer checks, or additional information before allowing certain features.
– We may refuse, suspend, restrict, or terminate accounts that violate these Terms, create risk, or are suspected of fraud, abuse, or unlawful activity.
- Vehicle listings and seller responsibilities
If you post, manage, promote, or submit a vehicle listing, you represent and agree that:
– You own the vehicle or have legal authority from the owner to list, advertise, negotiate, and sell it.
– The listing is truthful, accurate, complete, and not misleading.
– You will provide accurate information about the make, model, year, mileage, condition, accident history where known, import status, title/ownership status, price, taxes, fees, availability, location, and any material defects.
– You will upload only photos, videos, documents, and content that you own or are legally allowed to use. You must not upload another person’s personal data, identity documents, financial details, private communications, or photos of identifiable people unless you have a lawful basis and any required consent.
– You will not list stolen vehicles, illegally imported vehicles, vehicles with false documents, vehicles that cannot legally be sold, or vehicles that violate any law or third-party rights.
– You will promptly update or remove a listing if the vehicle is sold, unavailable, incorrectly priced, or materially changed.
– You are solely responsible for complying with all laws, taxes, customs, title transfer, registration, inspection, consumer-protection, advertising, and dealer-license requirements that apply to your listing or sale.
- Buyer responsibilities
If you browse, inquire about, inspect, reserve, or buy a vehicle, you agree that:
– You are responsible for independently verifying the vehicle, seller identity, ownership documents, registration, liens, taxes, import documents, condition, mileage, accident history, price, and availability before paying or signing any agreement.
– You should inspect the vehicle in person or through a trusted professional before completing any purchase.
– You should use safe payment methods and avoid sending money before confirming seller legitimacy and vehicle availability.
– Juba Car does not guarantee that any listing is accurate, available, lawful, roadworthy, safe, free of defects, or owned by the seller.
- User content
“User Content” means listings, photos, videos, descriptions, prices, messages, reviews, comments, reports, dealer profiles, logos, documents, and any other content submitted through the Service.
– You retain ownership of your User Content, but you grant Juba Car a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, translate, modify, distribute, promote, and use your User Content to operate, improve, market, and protect the Service.
– You are responsible for your User Content and for ensuring it is lawful, accurate, and does not violate the rights of others.
– We may review, moderate, edit, reject, remove, hide, restrict, or disable User Content at any time if we believe it violates these Terms, is inaccurate, creates risk, or may harm users or the Service.
– We may use automated tools, human review, user reports, and third-party moderation services to help detect fraud, spam, unsafe content, and policy violations.
- Prohibited content and conduct
You must not use the Service to:
– Post false, misleading, fraudulent, stolen, illegal, unsafe, or unavailable vehicle listings.
– Impersonate another person, business, dealer, or government authority.
– Harass, threaten, abuse, exploit, bully, defame, discriminate against, or intimidate any person.
– Post content that is sexually explicit, pornographic, exploitative, hateful, violent, extremist, obscene, profane, or otherwise objectionable.
– Create, upload, distribute, request, promote, or facilitate child sexual abuse material, child exploitation, trafficking, prostitution, sexual services, or harm to minors.
– Sell or advertise weapons, drugs, counterfeit goods, stolen goods, illegal services, or items unrelated to vehicle marketplace use.
– Upload malware, spyware, viruses, scripts, or harmful code.
– Scrape, crawl, copy, harvest, or use bots to access the Service without written permission.
– Bypass security, reverse engineer the app, interfere with the Service, overload infrastructure, or test vulnerabilities without permission.
– Collect or misuse another user’s personal information.
– Spam users, send unsolicited marketing, manipulate rankings, fake reviews, fake inquiries, or engage in deceptive advertising.
– Violate any law, regulation, third-party right, app-store rule, or these Terms.
- Reporting, blocking, and moderation
Juba Car provides safety and moderation tools to protect users and comply with app-store requirements. Users can report suspicious listings, offensive content, scams, abusive users, fake accounts, and safety concerns through in-app reporting tools or by contacting [support@yourdomain.com] . Where messaging or user interaction is available, users should be able to block abusive users from contacting them.
We may review reports, remove content, warn users, restrict listings, suspend accounts, block users, contact authorities, or take other appropriate action. We aim to respond to urgent safety, fraud, and illegal-content reports promptly, but we do not guarantee a specific response time.
- Payments, paid features, and refunds
– Juba Car may offer paid features such as promoted listings, dealer plans, subscriptions, listing packages, inspection requests, reservation services, lead tools, advertising placements, or other marketplace services.
– Prices, taxes, plan details, renewal terms, and refund terms will be shown before purchase where required.
– Payments for physical vehicles or physical services consumed outside the app may be processed outside Apple or Google in-app billing where permitted or required by app-store rules.
– Digital features consumed in the app, such as promoted listings, premium listing tools, app subscriptions, or digital upgrades, may be required to use Apple In-App Purchase or Google Play Billing depending on platform and region. Those purchases are also subject to the applicable Apple App Store or Google Play terms, refund processes, and billing rules.
– Unless otherwise required by law or app-store rules, fees for paid features are non-refundable once the feature has started, been used, or been delivered.
– We may refuse or cancel transactions, promotions, or paid features that are fraudulent, abusive, unlawful, incorrectly priced, or violate these Terms.
- Vehicle transactions and disputes between users
Juba Car may provide tools that help users communicate, discover vehicles, and manage listings, but users are responsible for their own transactions. Unless Juba Car expressly agrees in a separate written agreement, we are not a party to agreements between buyers and sellers and are not responsible for payment, delivery, title transfer, registration, taxes, insurance, inspection, defects, warranties, returns, refunds, or disputes involving vehicles.
If a dispute arises between users, you should attempt to resolve it directly and may also report safety, fraud, or policy concerns to Juba Car. We may assist at our discretion but have no obligation to mediate or resolve user disputes.
- No professional advice
Information in the Service, including vehicle descriptions, price estimates, financing information, inspection information, insurance information, registration information, and marketplace content, is provided for general informational purposes only. It is not legal, financial, tax, insurance, mechanical, engineering, safety, valuation, or professional advice. You should consult qualified professionals before making decisions.
- Third-party services
The Service may integrate or link to third-party services, including payment processors, app stores, maps, inspection providers, financing providers, insurance providers, dealers, sellers, transport providers, communication tools, analytics providers, and websites. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, content, payments, failures, or acts.
- Intellectual property
Juba Car and its logos, trademarks, designs, software, features, databases, text, graphics, and content are owned by Juba Car or its licensors and are protected by law. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as permitted by law or with our written permission.
- App license
Subject to your compliance with these Terms, Juba Car grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the app on devices you own or control for personal or internal business use. You must comply with all applicable app-store terms when using the app.
- Apple App Store additional terms
If you download or use Juba Car from the Apple App Store:
– These Terms are between you and Juba Car, not Apple.
– Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for the app.
– To the maximum extent permitted by law, Apple has no warranty obligation for the app.
– Apple is not responsible for claims relating to the app or your possession or use of the app, including product liability claims, legal or regulatory claims, or intellectual-property claims.
– Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as they relate to your licensed use of the iOS app.
– If Apple provides a standard EULA for the app, these Terms supplement that EULA unless a custom EULA is provided in App Store Connect.
- Google Play additional terms
If you download or use Juba Car from Google Play, your use may also be subject to Google Play’s terms, payment rules, refund processes, and app-store policies. Google is not responsible for Juba Car’s content, support, or user transactions except as required by applicable Google Play terms or law.
- Tanzania personal data protection responsibilities
Our processing of personal information is described in our Privacy Policy . Where Tanzania’s Personal Data Protection Act, 2022 (Cap. 44), its regulations, or PDPC requirements apply, the following additional responsibilities apply to Juba Car users, sellers, dealers, business customers, and partners.
– Use personal data only for the Service: If you receive another user’s name, phone number, email address, location, message, inquiry, or other personal data through Juba Car, you may use it only to respond to the inquiry, manage the relevant listing or transaction, provide requested support, or comply with law. You must not sell, rent, share, scrape, export, or reuse that data for unrelated marketing, spam, fraud, harassment, or profiling.
– Comply with Tanzania data-protection law: If you are a dealer, business seller, inspection partner, financing partner, insurance partner, advertising partner, or other business that independently determines how to use personal data received through Juba Car, you may be an independent data controller and must comply with applicable data-protection laws, including PDPC registration, DPO appointment, notices, lawful basis, security, retention, data-subject rights, and cross-border transfer requirements where applicable.
– Respect consent and opt-outs: You must honor user requests to stop marketing, withdraw consent, correct inaccurate data, restrict processing, or delete data where required by law.
– Protect leads and messages: You must keep buyer and seller leads, messages, contact details, and documents confidential and secure. You must promptly notify Juba Car at [privacy@yourdomain.com] if personal data received through the Service is lost, misused, accessed without authorization, or disclosed unlawfully.
– No unnecessary sensitive data: Do not request, upload, or share sensitive personal data through the Service unless it is strictly necessary, lawful, and clearly authorized. Sensitive data may include children’s data, biometric data, health data, financial-transaction details, identity documents, offences, religious or political information, or other high-risk information.
– Cooperate with rights requests: If Juba Car, a user, or the PDPC asks for assistance with a lawful data-subject request, complaint, investigation, correction, restriction, erasure, or breach response connected to data you received through Juba Car, you must cooperate promptly and in good faith.
– Do not bypass platform controls: You must not scrape listings, harvest contact information, copy user data into external databases, use automated bots, or contact users outside the purpose for which they provided their information.
- Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that your information will be handled as described in the Privacy Policy.
- Suspension and termination
We may suspend, restrict, or terminate your access to the Service, remove listings, hide content, disable messages, block devices, or take other action at any time if we believe you violated these Terms, created legal or safety risk, engaged in fraud or abuse, harmed users, or used the Service in a way that could damage Juba Car. You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.
- Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Juba Car disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, safety, and uninterrupted operation.
We do not warrant that listings are accurate, vehicles are available, sellers are legitimate, buyers are legitimate, prices are correct, documents are valid, vehicles are roadworthy, or transactions will be completed. Use caution and independent judgment.
- Limitation of liability
To the maximum extent permitted by law, Juba Car and its owners, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, vehicle defects, failed transactions, fraud by users, personal injury, property damage, or disputes between users arising from or related to the Service.
To the maximum extent permitted by law, Juba Car’s total liability for all claims related to the Service will not exceed the greater of: (a) the amount you paid directly to Juba Car for the Service in the three months before the claim; or (b) USD 100. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
- Indemnity
You agree to defend, indemnify, and hold harmless Juba Car and its owners, directors, employees, contractors, affiliates, licensors, and service providers from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from or related to your use of the Service, your User Content, your vehicle listings, your transactions, your violation of these Terms, your violation of law, or your violation of another person’s rights.
- Changes to the Service and Terms
We may update, modify, suspend, discontinue, or restrict any part of the Service at any time. We may update these Terms from time to time. When we make material changes, we will update the effective date and, where appropriate, notify you through the app, website, email, or another reasonable method. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
- Governing law and disputes
These Terms are governed by the laws of [the Republic of Tanzania / the Republic of South Sudan / your chosen jurisdiction] , without regard to conflict-of-law rules, unless mandatory consumer-protection, data-protection, app-store, or marketplace laws require otherwise. If Juba Car is registered, established, or primarily operating in Tanzania, use Tanzania law here unless your legal counsel confirms a different lawful choice. Courts located in [city and country] will have jurisdiction over disputes, unless applicable law requires another forum or regulator process.
